Ambit of Domestic Violence Act widened by SC
The Supreme Court in its landmark judgment has widened the scope of the Protection of Women from Domestic Violence Act, 2005 by making it gender-neutral.
● The Supreme Court ordered deletion of the words “adult male” before the word ‘person’ in Section 2(q) of the Act making it gender-neutral.
● The remaining part of the legislation would remain operative and was kept untouched.
● The Protection of Women from Domestic Violence Act, 2005 protects women from physical, sexual, verbal, emotional and economic abuse at home.
● The Supreme Court order paves way for prosecution of women and even non-adults for subjecting a woman relative to violence and harassment.
● It strikes down two words from Section 2(q) of Act which deals with respondents who can be sued and prosecuted under it for harassing a married woman in her matrimonial home.
● It also allows a woman to seek legal action against her daughter-in-law and even her minor grandchildren for domestic violence.
घरेलू हिंसा कानून की शिकायत अब महिला के खिलाफ भी की जा सकती है। सुप्रीम कोर्ट ने घरेलू हिंसा कानून 2005 की धारा 2(q) में वयस्क पुरूष शब्द को निरस्त कर उसकी जगह व्यक्ति कर दिया है। यानी अब घरेलू हिंसा के मामले में पुरूष ही नहीं महिला के खिलाफ भी केस दर्ज किया जा सकता है।
● दरअसल, एक मां-बेटी ने अपने पुत्र, उसकी बीवी तथा उनके बेटा-बेटी के खिलाफ घरेलू हिंसा की शिकायत दर्ज करवाई। मगर, मुंबई हाईकोर्ट ने धारा 2(क्यू) को देखते हुए सभी महिलाओं को शिकायत से बाहर कर दिया था। कोर्ट ने कहा कि इस कानून में वयस्क पुरूष के खिलाफ ही शिकायत की जा सकती है।
● पीठ ने बॉम्बे हाईकोर्ट का फैसला भी निरस्त कर दिया, जिसमें धारा 2(q) को हल्का किया गया था। इसमें कहा गया था कि इस धारा को अलग से न पढ़ा जाए बल्कि, कानून की योजना के अंदर ही पढ़ा जाए।
● कोर्ट ने कहा कि कानून की धारा 2(क्यू) के प्रावधान व्यर्थ होने के कारण कानून से हटाए जाते हैं। पीठ ने कहा कि यदि प्रतिवादी को सिर्फ वयस्क पुरूष के रूप में ही पढ़ा जाएगा, तो यह साफ है कि वे महिला संबंधी, जिन्होंने वादी को घर से निकाला है, वे इसके दायरे में नहीं आएंगीं।
● यदि ऐसा होगा तो कानून के उद्देश्य को पुरुषों द्वारा आसानी से समाप्त किया जा सकता है क्योंकि वे सामने नहीं आएंगे और महिलाओं को आगे कर देंगे।
