National Capital Territory (NCT) of Delhi continues to be a Union Territory
Delhi High Court on 4 August 2016 held that Lt. Governor is the administrative head of the National Capital Territory.
• A bench of Chief Justice G Rohini and Justice Jayant Nath dismissed AAP Government's plea challenging the Union Government’s 21 May 2015 notification giving absolute powers to LG in appointing bureaucrats in the national capital.
• The court said AAP government's contention that LG is bound to act on advice of Council of Ministers is without any substance and cannot be accepted.
• AAP Government had contended that the notification barring Anti Corruption Bureau (ACB) from proceeding against Central Government employees is neither illegal nor unsustainable.
• Ruling that the Service matters were outside the jurisdiction of Delhi Legislative Assembly, the court said that LG exercising the powers is not unconstitutional.
• The court also held as illegal AAP government’s order appointing Commission of Inquiry in the CNG fitness scam and DDCA scam since the same was issued without concurrence of LG.
दिल्ली हाईकोर्ट ने 4 अगस्त 2016 को कहा की लेफ्टिनेंट गवर्नर राष्ट्रीय राजधानी क्षेत्र के प्रशासनिक प्रमुख हैं.
• मुख्य न्यायाधीश जी रोहिणी और न्यायमूर्ति जयंत नाथ की खंडपीठ ने केंद्र सरकार के 21 मई, 2015 को राष्ट्रीय राजधानी में नौकरशाहों की नियुक्ति में एलजी को पूर्ण शक्तियां देने की अधिसूचना को चुनौती देने वाली आम आदमी पार्टी की सरकार की याचिका को खारिज कर दिया।
• अदालत ने कहा कि आम आदमी पार्टी की सरकार की दलील है कि एलजी मंत्रियों की परिषद की सलाह पर कार्य करने के लिए बाध्य है जो तथ्यहीन है और स्वीकार नहीं किया जा सकता है।
• आप सरकार ने तर्क दिया था कि भ्रष्टाचार निरोधक ब्यूरो (एसीबी) द्वारा केंद्र सरकार के कर्मचारियों के खिलाफ कार्यवाही करना या अधिसूचना जारी करना अवैध नही है।
• सेवा मामलों में दिल्ली विधान सभा के अधिकार क्षेत्र के बाहर हैं कहते हुए अदालत ने कहा कि एलजी द्वारा शक्तियों का प्रयोग असंवैधानिक नहीं है।
• इसके अलावा आम आदमी पार्टी की सरकार के आदेश से सीएनजी फिटनेस घोटाला और डीडीसीए के घोटाले के मामले में जांच आयोग नियुक्ति करने को भी कोर्ट ने गैर-संवैधानिक करार दिया क्योंकि ये एलजी की सहमति के बिना जारी किया गया था।
